Panel Discussion I aimed to help cross-boundary SMEs understand and observe the anti-corruption legislation in Guangdong, Hong Kong and Macao to avoid unnecessary disputes and lawsuits as well as breaches of laws. The panel discussion was hosted by Dr David WONG, JP, President of The Chinese Manufacturers' Association of Hong Kong, and joined by guest speakers from anti-corruption agencies in the three places, who briefed the participants on the anti-corruption laws in Guangdong, Hong Kong and Macao, possible risks faced by SMEs, and assistance and support provided by anti-corruption agencies in the three places. |

Ms MU reminded entrepreneurs from Guangdong, Hong Kong and Macao through real-life cases about the requirements of the anti-corruption laws in Hong Kong as well as the points-to-note for enterprises conducting cross-boundary business. Ms MU also encouraged the SME management to manifest their steadfast commitment to integrity management from top-down by implementing preventive policy and putting integrity into daily practices.

Dr WANG introduced to the participants the national laws on commercial bribery and its punishment as well as major government initiatives in combating corruption. Dr WANG said along with the socio-economic developments, the mode and form of bribery had also become more secretive. Such crimes were not only difficult to detect and collect evidence, but also had brought severe loss to the Nation and seriously hampered the principles of fair market competition. Dr WANG therefore reminded cross-boundary entrepreneurs of the need to comply with the local laws and uphold ethical business practices.

Mr ZHANG shared with entrepreneurs his rich investigative experience gained from working in the Economic Crime Investigation Department, Guangdong Provincial Public Security Bureau over the years and also explained the country's laws and requirements in combating commercial bribery. Based on the recent corruption trend of Mainland business community, Mr ZHANG highlighted some corruption-prone industries and common forms and characteristics of corruption in recent years.

Dr FONG used different cases to illustrate to the participants the laws on Preventing and Suppressing Bribery in the Private Sector in Macao enacted in March 2010. Dr FONG pointed out that the success of investigation of private sector corruption hinged on proactive whistle-blowing of enterprises and close cooperation of law enforcement agencies. He wished the level playing fields of Guangdong, Hong Kong and Macao could be effectively maintained by information exchange and collaboration of the three places.

Majority of the participants were highly concerned about the anti-corruption legislations in the three places. At the Open Forum, there were keen responses from the participants, particularly on the law enforcement aspects of the cases cited by the speakers, coverage and enforcement of anti-corruption legislations in the three places, their territorial restrictions, enforcement authorities and mechanism of handling cross-boundary corruption and bribery reports, etc. The guest speakers explained the details of the laws and once again reminded SMEs to note the legal requirements in different places when conducting business in order to avoid falling prey to corruption. They also hoped the governments and business sectors of the three places would continue to collaborate with one another on safeguarding a fair and just business environment in the PRD region.
