Prevention of Bribery Ordinance (Cap 201, Laws of Hong Kong)
Bribery involving public servants
Sections 4 and 8 of the PBO aim to ensure high integrity of public servants working for the Government and public bodies. It is a criminal offence for:
- Section 4
- ● any person (such as a bank staff member)
- ● without lawful authority or reasonable excuse
- ● in Hong Kong or elsewhere
- ● offering any advantage to any public servant
- ● to affect the public servant to perform or not to perform his duties.
- (It is also an offence for the public servant to solicit or accept the advantage.)
- Section 8
- ● any person (such as a bank staff member)
- ● without lawful authority or reasonable excuse
- ● offering any advantage to public servants while having dealings with the Government or any public body (no matter whether there is any intent to bribe and / or any special request has been made).
Maximum penalty: A fine of HK$500,000 and imprisonment for 7 years
