Ex-AAHK General Manager and sub-contractor face additional bribery charge involving Mainland property in 3RS Project’s sub-contracts corruption case

A former General Manager of the Airport Authority Hong Kong (AAHK) and the proprietor of a sub-contractor, who were among 10 people charged by the ICAC with multiple counts of bribery and other offences concerning sub-contracts of the Three-Runway System Project (3RS Project) of the Hong Kong International Airport, were laid with an additional corruption charge involving a Mainland residential property. The total bribe money involved in the cases had amounted to around HK$5 million, concerning works sub-contracts and materials purchase orders worth over HK$260 million in total.

The ICAC arrested various people on suspicion of corruption in operation “Blizzard” mounted in mid-August last year and subsequently charged 10 people in five cases. Upon further legal advice from the Department of Justice, an additional charge of conspiracy for a public servant to accept an advantage was laid against Yin Kek-kiong, 62, former General Manager of the AAHK, and Ng Kai-on, 66, proprietor of Carol Engineering Limited (CEL), a sub-contractor of the 3RS Project.

The other eight defendants, aged between 28 and 63, include former Principal Manager of the AAHK Ricky Lee Wing-fai and his wife Diana Chan Kok-tan. Three of the defendants are 3RS Project sub-contractor CEL’s former project manager Rob Liu Wai-lun, and sub-contractor Goldwave Steel Structure Engineering Limited’s director Alan Li Kam-on and Li’s associate Joseph Wat Ki-cheung. The remaining trio are two operators of Joint Field Engineering Limited, a supplier of the 3RS Project, namely Wong Ching-ng and Wong Bun-hon; and its sole director-cum-shareholder Wong Yu-hang.

Magistrate Mr Daniel Tang Siu-hung today (April 6) adjourned four of the cases involving nine defendants to June 15 for mention at the Eastern Magistrates’ Courts, pending the prosecution’s application for transferring the cases to the District Court. The nine defendants face multiple counts of offering an advantage to a public servant, conspiracy to offer an advantage to a public servant, conspiracy for a public servant to accept an advantage, conspiracy to offer an advantage to an agent and dealing with property known or believed to represent proceeds of indictable offence. On the other hand, the remaining case concerned a theft case involving Wong Yu-hang.

Yin Kek-kiong was an engineer employed by the AAHK on short-term contracts to assist in managing and supervising works, including those for the main reclamation and the new runway, under a number of contracts of the 3RS Project. Ng Kai-on was the proprietor of CEL, a filling materials supply and transportation sub-contractor of the 3RS Project.

The additional charge faced by Yin and Ng today alleged that between January 2018 and July 2019, the duo had conspired together with a female friend of Yin for Yin to accept bribes of RMB 580,000 (about HK$660,000) for assisting CEL to be favoured by a contractor of the reclamation works of the 3RS Projects, or for assisting CEL to secure a sub-contract for additional filling for the area under sloping seawall. The bribe payment was part of the payment for purchasing a Mainland residential property, while the sub-contract concerned was worth about HK$83 million in total.

Meanwhile, Ng is scheduled to appear at the Eastern Magistrates’ Courts for mention next Friday (April 14) to face three other additional charges against him.

An ICAC spokesperson noted that the corruption cases concerned the awarding of works and material supplies contracts, as well as administrative and financial matters. ICAC enquiries did not reveal any issues involving the quality of works or specifications of materials. The ICAC learned that the AAHK had conducted a comprehensive review on all relevant documents and records, with no abnormalities and deficiencies identified.

The ICAC will continue to maintain close liaison with the AAHK, which has rendered full assistance to the ICAC during its investigation into the cases. While corruption enquiries are continuing, the ICAC does not rule out further law enforcement actions and further prosecutions.

The prosecution was today represented by Acting Senior Assistant Director of Public Prosecutions Rosa Lo, assisted by ICAC officers Joan Wong and Marvin Chow.
